El uso de la inteligencia artificial en la minería de datos y textos: un análisis desde el derecho de autor

RESUMEN
El presente artículo tiene como objetivo analizar los retos que el desarrollo de la inteligen-
cia artif‌icial implica para la minería de textos y datos como excepción del derecho de autor. El
artículo se divide en tres partes; la primera, aborda la minería de datos y textos como técnica de
creación de un nuevo conocimiento, haciendo especial referencia a las tensiones que su uso re-
presenta para los derechos de autor y conexos, con especial referencia a su conf‌iguración como
limitación a los derechos de autor y conexos en el régimen jurídico para un mercado único digital
en la Unión Europea; en un segundo momento se explica el concepto de inteligencia artif‌icial
ética y sus principales implicaciones para los derechos de propiedad intelectual; por último, el
artículo analiza los dos grandes retos que tiene la utilización de la inteligencia artif‌icial en este
tipo de tecnología, su protección como tecnología de análisis y la posibilidad de crear un nuevo
conocimiento que sea considerado una obra susceptible de protección por el régimen jurídico
de los derechos de autor.

ABSTRACT
The objective of this article is to analyze the challenges that the development of artif‌icial
intelligence implies for the Text and Data Mining as an exception to copyright. The article is
divided into three parts, the f‌irst deals with the Text and Data Mining as a technique for creating
new knowledge, making special reference to the tensions that its use means for copyright and
related rights, with special reference to its conf‌iguration as a limitation to copyright and related
rights in the legal regime for a digital single market in the European Union; in a second moment,
the concept of ethical artif‌icial intelligence and its main implications for intellectual property rights
