RESUMEN
Considerados parte esencial de la compensación por daños derivados de un ilícito de Dere-
cho de la competencia, tanto por la Directiva como por la jurisprudencia del Tribunal de Justicia,
los intereses han de devengarse desde el momento de producción del ilícito hasta el completo
pago de la indemnización. El artículo analiza la legislación española en materia de intereses, en
concreto, las vías que ofrece la misma respecto del marco temporal cubierto y las cuantías a las
que se puede acceder por el demandante, con el objeto de comprobar si se cumple con el principio
de efectividad exigido por el legislador europeo. Se concluye que las medidas recogidas en el Có-
digo Civil y Ley de Enjuiciamiento Civil ya permiten obtener el pleno resarcimiento de las víctimas.

ABSTRACT
Considered to be an essential part of the compensation of damages arising from an infrin-
gement of Competition law, both by the Directive and by the case-law of the European Court of
Justice, interest must accrue from the moment of production of the infringement until the com-
pensation is fully paid. The article aims at analysing the Spanish legislation on interest, in parti-
cular, the means injured parties have at their disposal to claim it, as regards time-frame covered
and the amounts which may be accessed, in order to ultimately verify whether it complies with
the effectiveness principle. It is f‌inally concluded that the provisions in the Civil Code and the Civil
Procedure Act already allow full compensation to be obtained by the victims.
