RULE OF LAW AND DEMOCRACY IN THE REPUBLIC
OF COLOMBIA IN THE FACE OF THE PLAGUE
RESUMEN: Al Estado de Derecho y a la democracia constitucional en la Re-
pública de Colombia les ha correspondido afrontar la tragedia de la peste.
La institucionalidad ha acusado una grave debilidad y las acciones de las
autoridades, a todo nivel, presentan una característica y es que no han estado
a la altura del reto de afrontar una emergencia sanitaria de la magnitud que
requiere un sistema de salud eciente, ecaz y de libre acceso a la comuni-
dad. La respuesta de las autoridades públicas ante la escalada de contagios y
fallecidos a consecuencia de la peste ha sido lenta; no obstante, la peste no
es la única responsable de la tragedia. Nos tomó de sorpresa, como regular-
mente ocurre y no debió ser así, debimos estar preparados. Las mismas au-
toridades han estado con las manos atadas para ofrecer respuestas adecuadas
y urgentes a la peste y sus efectos, y esta lentitud en sus acciones se asocia
a la ausencia de deliberación cientíca y política y de adopción de medidas
efectivas para frenar el contagio y aislar el coronavirus como se ha aislado
en Vietnam, China, Corea del Sur, Nueva Zelanda, Portugal, Grecia y otros

países. Las autoridades han estado imposibilitadas por instituciones políticas
rígidas, no democráticas, que no permiten la defensa de la comunidad ante
la peste. Este trabajo examina el diseño institucional del Estado de Derecho
y la democracia constitucional en la república de Colombia y su relación con
el tratamiento de la peste.

ABSTRACT: e rule of law and constitutional democracy in the Republic of
Colombia has had to face the tragedy of the plague. e institutional frame-
work has shown a serious weakness and the actions of the authorities, at all
levels, have a characteristic and that is that they have not risen to the chal-
lenge of facing a health emergency of the magnitude that an ecient health
system requires. eective and freely accessible to the community. e response
of public authorities to the escalation of infections and deaths as a result of
the plague has been slow; however, the plague is not solely responsible for the
tragedy. It took us by surprise, as it regularly happens and it shouldn’t have
been that way, we should have been prepared. e same authorities have been
with their hands tied to oer adequate and urgent responses to the plague and
its eects, and this slowness in their actions is associated with the absence
of scientic and political deliberation and the adoption of eective measures
to stop the contagion and isolate the coronavirus as it has been isolated in
Vietnam, China, South Korea, New Zealand, Portugal, Greece and other
countries. e authorities have been handicapped by rigid, undemocratic po-
litical institutions that do not allow the defense of the community against the
plague. is paper examines the institutional design of the rule of law and
constitutional democracy in the Republic of Colombia and its relationship
with the treatment of the plague.
