A LA STS 249/2008 (SALA DE LO PENAL),

RESUMEN
En el presente artículo analizamos la STS 249/2008 (Sala de lo Penal), de 20
de mayo, en lo tocante a su pronunciamiento respecto de la admisibilidad de
la obtención de la IMSI (International Mobile Subscriber Identity) por las fuer-
zas policiales (en este caso, la guardia civil) sin necesidad de resolución judi-
cial ha bilitante. El interés d e dicha senten cia rad ica en que, al ma rgen de
algunas afirmaciones cuestionables, la solución que aporta al asunto enun-
ciado supone un avance considerable en la clarificación del régimen de pro-
tección jurídi ca que debe dispensarse a los datos de tráfico con vistas a su
utilización con fines de investigación penal, que viene a sumarse a sentencias
igualmente próximas en el tiempo. Frente a los primeros pronunciamientos en
que abordó la materia referida, el Tribunal Supremo (TS) comienza a mantener
una línea uniforme e integradora de los distintos supuestos que se plantean
en relación con el acopio de información proporcionada por los datos de trá-

fico, deslindando , aunque aún con ciertas contradicciones, los casos en los
cuales es el derecho al secreto de las comunicaciones el afectado de aquellos
en que es el derecho a la protección de los datos de carácter personal, en toda
su trascendencia, el que debe centrar el debate procesal-constitucional.
ABSTRACT
This article analyzes the sentence STS 249/2008 (Criminal Court), dated May
20th, with reference to its pronouncement concerning the admissibility of a po-
lice force (in this case, the Civil Guard) to obtain the IMSI (International Mo-
bile Subscriber Identity) without an authorizing court order. The interest in the
aforementioned sentence lies in the fact that, while ignoring some questionable
statements, the resolution to the problem proposed supposes a considerable
advance in the clarification of the regime of legal protection that should be ac-
corded to data from traffic with respect to its use for criminal investigation,
and which can be added to other recent sentences. As opposed to the first sen-
tences that dealt with this q uestion, the Supreme C ourt h as now star ted to
maintain an integrating and uniform line concerning the different circumstan-
ces surrounding the acquisition of information provided by official data con-
cerning traffic, distinguishing, although with certain contradictions, the cases
in which it is the right to secrecy in communications that is affected from those
in which it is the right to the protection of personal data, with all that this en-
tails, which should be the centre of the constitutional-procedural debate.
