¿UNA CUESTIÓN ABIERTA? *

RESUMEN
El presente trabajo tiene por objeto examinar si la regulación de la Ley de
Navegación Marítima, así como algunas de las modificaciones legislativas que
se han producido recientemente en nuestro país en el sector del transporte, han
tenido repercusión en el régimen de responsabilidad del transitario y han clari-
ficado esta cuestión. En particular, se realiza un análisis del art. 278 de dicha
ley, que parece equiparar en todo caso al transitario con el porteador contrac-
tual. También se hace referencia a la actuación del consignatario de buques
como transitario, que se prevé en el art. 324 de la Ley de Navegación Marítima.
Como resultado del estudio efectuado se pone de manifiesto que el régimen de
responsabilidad del transitario sigue siendo una cuestión abierta a la que no han
dado respuesta conveniente ni la Ley de Navegación Marítima ni las anteriores
reformas legislativas de los últimos años en el ámbito del transporte, ocasio-
nando incluso dudas e incertidumbres. Por ello, se propugna la elaboración en
nuestro ordenamiento jurídico de una amplia y adecuada regulación jurídica del
transitario y, en general, de los intermediarios de transporte, que dé solución a
todas las cuestiones que plantea su intervención en la actividad del transporte,
en particular las relativas a su responsabilidad.

The freight forwarder’s liability after the Spanish Maritime Navigation Act:
an open question?
ABSTRACT
The purpose of this paper is to examine whether the regulation of the Spanish
Maritime Navigation Act, as well as some of the legislative modifications that
have recently occurred in Spain in the transport sector, have had an impact on
the freight forwarder’s liability regime and have clarified this issue. In particular,
an analysis is made of article 278 of that Act, which seems to equate in any case
the freight forwarder with the contractual carrier. Reference is also made to the
action of the shipping agent as a freight forwarder, which is provided for in article
324 of the Spanish Maritime Navigation Act. As a result of the study carried out,
it is clear that the freight forwarder’s liability regime remains an open question to
which neither the Spanish Maritime Navigation Act nor the previous legislative
reforms of recent years in the field of transport have given an adequate response.
All this has caused even doubts and uncertainties. Therefore, it is advocated
the elaboration in our legal system of a wide and adequate legal regulation of
the freight forwarder and, in general, of the transport intermediaries, that gives
solution to all the questions raised by its intervention in the transport activity, in
particular those related to its liability.
