TERRORISMO, HUMILLACIÓN A LAS VÍCTIMAS Y DELITOS DE ODIO

RESUMEN
En los últimos meses estamos conociendo una serie de sentencias sobre
enaltecimiento del terrorismo, humillación a las víctimas y delitos de odio que han
suscitado un gran debate en la sociedad, debate que versa sobre si son excesivas las penas
que se están fijando por estar anulando la libertad de expresión, derecho fundamental que
recoge la Constitución Española. Pues bien, en esta exposición voy a analizar qué se
entiende por cada uno de estos conceptos y tres sentencias dictadas por el Tribunal
Supremo, que reflejan la aplicación de la legislación española y comunitaria, así como los
límites del derecho a expresarse sin perjudicar la dignidad de personas individuales o
grupos.

ABSTRACT
In recent months we have been hearing a series of judgments on the exaltation of
terrorism, humiliation of victims and hate crimes that have provoked great debate in
society, This debate is about whether the penalties that are being set for annulling freedom
of expression, a fundamental right enshrined in the Spanish Constitution, are
excessive. Well, in this presentation I will analyse what is meant by each of these concepts
and three judgments handed down by the Supreme Court, which reflect the application of
Spanish and Community legislation, as well as the limits of the right to express oneself
without harming the dignity of individuals or groups.
