Resumen
En el presente artículo, he tratado de reflejar los aspectos concursales que presentan
los tipos penales de fraude de subvenciones (especialmente en su modalidad de obtención,
recogida en el art. 308.1 de nuestro vigente Código penal) y el delito de estafa, desde la
introducción del primero de ellos en el año 1985, cuestión que ha sido objeto de debate
por la doctrina desde aquel tiempo hasta nuestros días.
Abstract
In the present article, I have to reflect the concursales aspects that present the
penal types of fraud of subventions (specially in its modality of obtaining, collection in
article 308.1 of our effective penal code) and the crime of swindle, from the introduction
of first of them in 1985, question that has been object of debate by the doctrine from
that time to our days.
