RESU MEN: El nuevo régimen jurídico de la
contr at ación menor, r egulado en la recien te Ley de
contr atos del Sector Público, ha provocado un sin fin de
reacciones: polém icas y discrepancias interpret at ivas,
contr adicciones doctrinales y m ultitud de inform es
diver gentes, han provocado un context o de inquietud y
confusión, provocando inseguridad j urídica tanto en el
Sect or Público y a las pr opios adjudicatarios y
licitadores. La Administración Local, y esp ecialm ent e las
entid ades locales menores h an sido las m ás afect ada d e
est a incertidumb re j urídica.
Hay que replantearse si estas entidades locales
realmente se le pueden exigir los mismos requisitos
que al r est o de Adm inist raciones como la del Estado o
Diput aciones que disponen de suficientes recursos

econ óm icos y personales, para hacer fr ente a est e
nuevo régimen contr act ual. El result ado es u na
legislación que no valora factores como el tamaño, el
pr esupu esto y la or ganización de las adm inistr acion es.
Por ello, mant en em os una post ura escéptica a la
erradicación t ot al de esta figura contractual del
contr at o menor, porque con su utilización correcta, es
un gran instru ment o de gestión contractual que
consigue celeridad y agilidad para satisfacer el inter és
gen eral.

ABSTRACTAT: The new legal regim e of hiring less
regulated in the recent Public Sector Contr act s Act has
caused a my riad of react ions: cont roversies and
inter pr et at ive discrepancies, doct rinal cont radictions
and a m ultitude of divergent reports have given r ise to
a cont ex t of concern and confusion, causing legal
uncertaint y in both the public sector and the bidders
them selves. Local government , and especially smaller
local authorit ies, have been t he most affected by this
leg al u ncer taint y.
We need t o consider whet her these local aut horities can
really be required t o meet t he same requirement s as
the other adm inistrations such as the state or
par liam ents which have su fficient f inancial and personal
resources to deal with this new cont ractual regime. The
result is legislation th at does not value factors such as
the size, b udget and organisation of adm inist rat ions.
That is why we are scept ical about the total eradication
of this m inor contract figur e, because with its correct
