RESUMEN
La valoración de la prueba testifical posee una gran trascendencia en el ámbito
jurídico, máxime cuando en el proceso judicial nos encontramos únicamente con el
testimonio de un solo testigo. La fuerza probatoria que pueda tener esta declaración
singular constituye una cuestión peliaguda para el juzgador en su tarea de apreciación
de la prueba. En este trabajo nos cuestionamos qué eficacia probatoria le otorga el juez a
este único testimonio en el proceso desde la perspectiva del Derecho romano y de la
jurisprudencia del Tribunal Supremo español

ABSTRACT
The assessment of the witness evidence is very important in the legal sphere,
especially when in the judicial process we find only the testimony of a single witness.
The evidential value of this testimony alone is a difficult issue for the judge in his role
of assessing judicial evidence. In this paper we question what evidentiary effect the
judge grants to this only witness in the proceedings from the perspective of Roman law
and the jurisprudence of the Spanish Supreme Court.
