Resumen
Muchas tergiversa ciones y falsedades se ha n acumulado en torno al concepto de Cons-
titución, incluso a día de hoy, es increíble ver cómo abogados , politólogos y políticos
son v íctimas de ello. Este estudio tiene como obj etivo ver cómo resultado de dos de las
grandes falacia s constr uidas durante la modernid ad –la asimi lación y confusión entre
los conceptos de representativ idad y democracia , y los conceptos de legalidad y legiti-
midad–, se ha producido una tergiversación de la idea de soberanía pasando de la sobe-
ranía «popular» a la «sob eranía del derecho»), y, por tanto, de la idea de Con stitución,
que ha llevado a llamar Constituciones a normas que, desde el punto de vista de la
teoría democrática, no son constituciones, s ino Leyes.
Analiz ada esta adulteración del concepto de Constitución y su razón de ser, el artícu lo
expone cómo en los últimos años, los mov imientos sociales de pueblos latinoamericanos
han sido capaces de de -construir las f alacias de la modernidad e impulsar nuevos pro -
cesos de re-sob eranización en el cont inente.
Abstr act
So many misrepresentations and falsehoods have been accumulated a round the con-
cept o f Constitut ion that is, to day, amazing to see how even lawyer s, politica l scientists
and p oliticians are victims of them. This st udy aims to analy ze how as the res ult of t wo
of the g reat fal lacies bu ilt duri ng modernit y –the assimi lation a nd confus ion between
the concepts of repres entativeness and democrac y, and the concepts of leg ality and
legitimac y–, there has b een a misrepresentation of the idea of sovereignty (going from
the «people’s sovereignty» to the «sovereignty of the law»), and, therefore, of t he idea
of C onstitution, which has led to cal l Constitutions to ru les which, from the standpoint
of demo cratic theor y, are not constitutions but Act s.
Analyz ed this adulteration of the concept of Constitut ion and their reasons for being,
the ar ticle will ex pose how, in recent years, Latin American soci al movements have been
able to de- construct t he fall acies of the modernity and push towards new processes of
people’s re- soberanization on the continent.
