Resumen
Este artículo abor da las incidencias en la Sección Penal de la Comis ión General de
Codif icación entre 1858 y 1863, etapa en la que nuestro incipiente Estado liberal pedía
con u rgencia una nueva orga nización judic ial, el cambio de su normat iva crim inal y la
creación de un pro cedimiento penal. Junto a la C omisión, el Ministro Fernández Negrete
fue u no de los principales defen sores de la reforma de la justicia criminal española. E n
los t rabajos de ambos se basaron la s Leyes Orgánica del Poder Judicial de 1870 y Provi-
sional de Enjuiciam iento C riminal de 1872, y el C ódigo Penal de 1870.
Abstract
This article approaches the incidences in the Penal S ection of the General Commi s-
sion of Code between 1858 and 1863, stage in which ou r incipient liberal St ate requested
with urgency a new judicia l organization, its normative cri minal’s change and the creation
of a p enal procedure. Next to the Commi ssion, the Mini ster Fernández Negrete was one
of t he main defenders of the refor mation of the Span ish crimin al justice. In the works
of both the Organic Laws of the Judicial Power of 1870 were based and Prov isional of
Crimina l Prosecution of 1872, and t he Penal Code of 1870.
