RESUMEN: Numerosas novedades legislativas y reglamentarias, así como
pronunciamientos jurisprudenciales, jalonan el discurrir del año 2021 en
materia de fauna en España. Destacando tres como más importantes: la
modificación del Cc para introducir una regulación novedosa sobre los
animales, la nueva Ley de Caza de Castilla y León que trata de resolver los
problemas sobre especies cazables, entre ellas el lobo, y, en
contraposición, la modificación del Listado de Especies Silvestres en
Régimen de Protección Especial para intentar evitar la caza de ejemplares
de esta especie al norte del río Duero.
Además, se siguen produciendo acotaciones jurisprudenciales a los
respectivos regímenes legales sobre especies protegidas, especies exóticas,
silvestrismo y responsabilidad patrimonial causada por la fauna.
ABSTRACT: Numerous legislative and regulatory developments, as well as
jurisprudential pronouncements mark the course of the year 2021 in terms
of fauna in Spain. Highlighting three as most important: the modification
of the Cc to introduce a new regulation on animals, the new Hunting Law
of Castilla y León that tries to solve the problems on huntable species,
including the wolf, and in contrast the modification of the List of Wild
Species under a Special Protection Regime to try to prevent the hunting of
specimens of this species north of the Duero River.
In addition, jurisprudential annotations continue to be produced to the
respective legal regimes on protected species, exotic species, silvestrismo
and patrimonial responsibility caused by fauna.
