ELOGIO DE LA DESHEREDACIÓN1

Resumen
La realidad de los D espachos notariales prueba que el sistema legitimario est ablecido
por el Código civ il recibe un respaldo amplísimo de los t estadores, superior incluso al 90%.
Eso signif ica –a juicio del autor– que no tiene sentido e stablecer un sistema de ab -
soluta libertad de t estar, sino que sólo hay que dar cauce a ese pequeño porcentaje que
entra en colisión con el actua l sistema legitimario. Es decir: manteniendo nuestro sistema
legitimar io, hay que «darle aire y oxígeno» par a que pueda acoger a los testadores que
chocan con él.
Y en esa tarea de da r aire a las legítimas, el autor entiende que la desheredación es
la pieza fundament al, con la única condición de que no sea interpretada rest rictivamente.
Abstract
The real every day work at the public notary st udies shows that the rest rictions to
testators enforced by t he Civil Code (in Spain called «legít imas»), are agreed with the
wishes of a large majority of clients (even more 90%).
It means –in my opinion– t hat a system of «testa mentary complete freedom» is just
not necessary. Other wise, would be enough to receive in the actual system t his few
people that crash w ith the actua l restrictions to make last wil l and testament. I say : the
actual system is a good system which on ly needs «fresh air and ox ygen» to receive this
few people that, actu ally, disagree w ith the restr ictions.
How? The author thinks that «disinherit» is the basic piece, wit h a simple warning:
never make restr ictive inter pretations.
