ESUMEN
La inserción del j udicial review en el sistema constitucional peruano obedece al
aporte del constitucionalismo liberal. Esta institución fue asimilada en el Perú a lo largo
del S. XX, para llegar a ser consolidada como un mecanismo clav e, en el ejercicio de la
función jurisdiccional, de órganos como el Tribunal Constitucional y, el Poder Judicial
ambos comisionados del poder constituyente.
El judicial review es acogido en la Constitución Política del Perú de 1993, en su art
138, bajo la figura de ser una función jurisdiccional y, cuyo antecedente claro, se
encuentra en la constitución anterior de 1979. Así, desde su regulación constitucional, se

conocerá como el constituyente peruano, ha ingresado esta institución y, su aplicación
como mecanismo para controlar las leyes infraconstitucionales frente a la Constitución.
Al ser un mecanismo de c ontrol constitucional, se incidirá en el papel del Tribunal
Constitucional y del Poder Judicial en la interpretación que del mismo se ha realizado en
sus decisiones jurisprudenciales, con la finalidad de dar contenido a la manera de aplicar
dicho control de la constitucionalidad en el orden jurídico peruano.

BSTRACT
The insertion of judicial review in the Peruvian constitutional system is due to the
contribution of liberal constitutionalism. This institution was assimilated in Peru
throughout the 20th century, to become consolidated as a key mechanism, in the exercise
of the jurisdictional function, of bodies such as the Constitutional Court and the Judiciary,
both commissioners of the constituent power.
The judicial review is welcomed in the Political Constitution of Peru of 1993, in its
article 138, under the figure of being a jurisdictional function and, whose clear anteced-
ent, is found in the previous constitution of 1979. Thus, since its constitutional regulation,
it will be known as the Peruvian constituent, this institution has entered and its applica-
tion as a mechanism to control infra-constitutional laws against the Constitution.
As it is a constitutional control mechanism, the role of the Constitutional Court and
the Judicial Power will be influenced in the interpretation that it has made in their juris-
prudential decisions, in order to give content to the way of applying said control of con-
stitutionality. in the Peruvian legal order.
