Resumen
Este artícu lo pretende abordar el ya clásico debate en torno a la legiti midad de la jus-
ticia constitucional y de la propia constitución como norma suprema del ordenamiento
jurídico, gara nte de un núcleo indisponible de derechos y l ibertades. A t al fin, se llevará
a cabo un sucinto aná lisis de la evolución histórica de la justicia constitucional est adouni-
dense para intentar perfilar la imperiosa actualización del marco jurídico -constitucional
norteamericano, renovación que se ha convertido, con el devenir del tiempo, en una exi-
gencia real y palpable que ha de analizar se desde la óptica del Derecho compar ado.
Abstract
This art icle intends to treat the «classic» debate around t he legitimac y of constitu-
tional justice a nd of the Constitut ion itself as the supreme law of t he legal system a s
guarantee of the bare essenti als of rights and freedoms. For that purpose, a brief analysis
of the historica l evolution of American constitutional justice will be c arried out, in a n
attempt to outline the urgent need to update the Amer ican legal-constitutional frame-
work, a restructu re that has become, w ith the pass age of time, in a clear necessity that
should be analyz ed from a compared law view point.
