SOBRE LAS CLÁUSUL AS A BUSIVAS: A PROPÓSITO
DE LA LEY COMPLEMEN TARIA DEL SISTEM A DE PROTECCIÓN
AL CONSUMIDOR DE PERÚ

Resumen
En las líneas s iguientes el autor centra su atención en un problem a acuciante: las
cláusula s abusivas. Par a ello, alude en primer lugar a lgunas cuestione s doctrinaria s
de interés que le permit irán encarar de mejor maner a la cuestión desde el plano le-
gislativo. Así, inicia el r ecorrido por el frustrado Proyecto de Reforma a l Cód igo civ il
peruano, que entre otras mod ificaciones, incorporaba di sposiciones relativ as a las cláu-
sulas vejatorias, mejorando cualitativa y cu antitativamente las d isposiciones del Código
sustantivo. Final izado este pu nto, el autor recala en el tratamiento dual que sobre el
particul ar presenta el derecho peruano. La normativ a del Código civ il así como la Ley
de Protecc ión al Consu midor (y la prevista pa ra el consumidor de serv icios financieros)
y su reciente modi ficatoria – Decreto Legislat ivo 1045–, permiten most rar un panorama
suficientemente amplio de las respuestas del legislador nacional de car a a la tutela del
consumidor frente a cl áusulas que intro ducen desequi librios i mportantes en cu anto a
la at ribución de derechos y obligaciones , que por igual, debería n corresponderle en sus
relaciones que entabla con el empresar io en sede del mercado; y que se ofrece como el
contexto más propicio para evidenci ar el «sentir» pa rticular que s obre tan álgid a proble-
mática tiene el autor de este esc rito.

In the following lines the author focu ses his attention on a imperative problem:
the abusive claus es. He alludes i n the first place some doctrinar y topics that w ill allow
him to face in a better way the problem from the legislat ive perspect ive. Thus, it start s
the path by the f rustrated Project of the Reformation to the Peruvian Civil C ode, that
among others mod ifications, incor porated dispositions r egarding the unf air clauses,
improving qualitatively and quantitatively the dispositions of the C ivil Code. Fina lized
this topic, the aut hor emphasizes in the dual treatment that the Peruvian L aw has of it.
The Civ il Code normat ive as well as the Law of Protection t o the customer (and the one
foretold for t he customer of the financi al services) a nd its recent modifying –Legislative
Decree 1045– a llows to show a wide scena rio of the nat ional legislat or’s answers facing
the t rusteeship of the consumer against clauses that introduce impor tant imbalances as
far as t he attribut ion of rights a nd obligations , that also should have to cor respond in
it’s relations with the businessman in soothes of the m arket; and t hat is of fered like t he
most propitious context to demonstrat e the individual «feeling» that the author of this
text has about this issue.
