Resumen
En el momento del inicio del matrimonio, la s relaciones de propiedad se utilizan
para adquir ir un valor sign ificativo en la mayor parte de las sociedades trad icionales:
en algunos paí ses, los padres de la nov ia adjudicarán sus hijas la dote, el tamaño de la
misma será acorde par a determinar la elección del novio. En otros países, e specialmente
en el Oriente, un novio paga ría un rescate por su novia. En algunos países, est as costum-
bres se conserva n hasta nuestros d ías y constituye una parte tradicional de un acuerdo
matrimonia l. Por ejemplo, en las diferentes culturas los padres de la novia deben ceder
una parte de sus bienes a los recién casados (conocidos como dote). La dote que da la
práctica es sim ilar en países como Grecia, Egipto, India y C hina. Este tipo de propie-
dad existe en otros países de distinta religión y costu mbres. Por ejemplo, la ley hindú
otorga la propiedad de la esposa como Stridhanam. E l trabajo ana liza el problema, que
es relevante, tanto teór ica como prácticamente, ya que trata de divulgar la def inición
y la importanci a de la reglamentación de las relaciones de propiedad entre cónyuges
mediante el análisis de las leyes, va rias obra s literaria s de carácter cientí fico y legales
relacionados con este tema, a sí como la práctica judicial.
Abstract
At the time of the beginning of marriage, propert y relations use to acquire a signif i-
cant value in most traditional soc ieties: in some countries, parents of the bride award
their daughters with the constitution of a dow ry. Its size wi ll be in line to determ ine the
choice of boyfriend. In ot her countries, especially in t he East, the boyfriend pay a ra nsom
for his girlf riend. These customs are preserve d still nowadays and constitutes a t raditional
part of a marr iage settlement. For example, in different cultu res parents of the bride must

give up part of thei r property to the newly married (know n as dowry). Dowry i s similar
in countries like Greece Egypt, I ndia and China. This kind of proper ty exists i n other
countries with d ifferent religions and c ustoms. For example, the Hindu law g ives the
ownership over wife a s Stridhanam. This work st udies the important problem (theoretical
and practically), as it tries to disclose t he definition and importance of the reg ulation of
the property relat ions between spouses by a n analysis of t he laws, several l iterary, legal
and scientific works related to this topic a nd the judicial practice.
