The Inequalities In The Working World

Summary: This article analyzes the meanings of the idea of inequality in the working relations, its liberal origin and its difficult translation in the wage relation. However, the tension to equality is inherent to the working world, although since the 90s last century the homogeneity which comes from the equality treatment suffers a real deflagration and the differences referred to many subjective situations, to different identities come to the first level. In another level a policy of the Laws and the company is established, and it wants to break consciously the solidarity base and the egalitarianism on work. These authoritarian incentives are giving ground, as we can see in the FIAT case and its management. Nevertheless, it is possible to remake the frame of working regulation on an equality demand. The presence of the Italian Workers Statute testifies it, and in it work and citizenship can develop that course, measured by the union action.

The Rules Of The Self-Employed Worker A Long-Range Legal Intervention?

Summary: The rules of the self-employed worker, especially those of the TRADE, is another legal intervention which is in line of the trend to restrict the area of application of the Labour Law. It means a change of the characteristic elements of the long-range discipline through the revaluation of the individual autonomy of the strong contractor for the qualification of the contract, avoiding and changing the application of the working and civil areas, and it expands its limit effects to the rest of the working benefits typified in the art. 1.1. ET. The LETA is given an expansive vis which aggravates the restrictive vis of the Labour Law.

Related to the self-employed workers, the union freedom fades, making it difficult the separation between the association rights and the union freedom. The common law-maker allows himself the recreation of a “special” union freedom right, which has a great cut in its essential content because it does not consider the right to negotiate agreements...
