RESUMEN: La necesidad de actuar con los propietarios de suelo en el curso
de los procesos reparcelatorios exige, tanto de la Administración como de las
entidades urbanísticas que tienen legalmente encomendado el desarrollo de los
actos iniciales del proceso, vigilar con especial atención la realización de aquellas
actuaciones previas encaminadas a su identificación y localización, tarea en la
cual cobra una importancia central, en primer lugar, la información obtenida de
los asientos del Registro de la Propiedad por la presunción de titularidad que
de ellos resulta y, sucesivamente, los medios que de modo subsidiario ofrece el
ordenamiento con el mismo fin de tal modo que pueda quedar garantizada la
legalidad formal y material del conjunto de las actuaciones mediante la correcta
definición del cuadro completo de los titulares de suelo afectados.
ABSTRACT: The need to act with the owners of land in the course of reparcelling
processes requires both the Administration and the urban development bodies legally
entrusted with the development of the initial acts of the process to monitor with
special attention the performance of those preliminary actions aimed at identifying
and locating them, In this task it is important, in the first place, the pronouncements
of the Land Registry due to the presumption of ownership that the registry entries
provide and, subsequently, the alternatives that the system offers in a subsidiary
manner to guarantee the formal and material legality of the actions through the
correct definition of the complete list of affected land owners.
