Abstract: This text analyzes the regulation of the intended introduction of the system of dual professional training through the RD 1529 / 2012.

Starting from the importance of the professional training to improve the employability of the worker as much as the competitiveness and the business development, we present some doubts the Spanish legal model shows in its role. Even so, this work focus on a review of the mentioned RD 1529 / 2012 (including a reference to the STC about it) from a general and previous perspective, to investigate if this model really approaches to the one which is its reference (the German model); and the analysis of the specific regulations, to identify the possible problems of interpretation and appliance that we consider our regulation of the dual system (both working and educational nature) can involve, that’s why this study raises the regulations and experience (especially regional) before and after the entry into force of it.

THE IDENTIFICATION OF CONTRACT AND WORK IN THE ORIGINS AND NOWADAYS IN THE ITALIAN LAW

Abstract: The author starts from an analysis of the identity crisis which is having the employment law, and its jurists, to turn back time and individualize some of the theoretical approaches which have influenced the current employment law. Specially, the author points out as a possible "guilty" of some of the problems of the employment law, the excessive emphasis on the role of the individual contract, its role of regulation of the working relationship which has caused the identification of the job and the contract itself. Furthermore, he upholds the real feature of the employment law, which makes it different of the civil law, is its collective dimension and the own figure of the trade union. In this historical itinerary we point out that the modern employment law is very similar to that of the origins, of the first years of the 20th century.
