RESUMEN: Este trabajo propone una revisión crítica de la doctrina
consolidada del Tribunal Supremo en torno a la protección del llamado
tercero hipotecario. A partir de la Sentencia de Pleno, de la Sala de lo Ci-
vil del Tribunal Supremo de 5 de marzo de 2007, queda fijada la doctrina
jurisprudencial en torno al concepto de tercero hipotecario y la debatida
cuestión de la atribución de la propiedad al segundo adquirente cuando
la adquisición estuviera inscrita en el Registro de la Propiedad y aunque
existiera una transmisión previa consumada pero no inscrita. Mediante este
posicionamiento nuestro Alto Tribunal afronta una cuestión clásica en el
ámbito civil-hipotecario que, a juicio de esta autora, merece revisión pues, a
partir de la señalada resolución, así como en otras posteriores que siguen el
criterio declarado por aquella, conformando ya un cuerpo de doctrina juris-
prudencial al respecto, la Sala Primera del Tribunal Supremo fijó doctrina
sobre el concepto de tercero hipotecario, dando respuesta a una cuestión ju-
rídica que ha sostenido un prolongado debate doctrinal y jurisprudencial en
torno al artículo1473, párrafo 2.º, del Código civil, cual es el mantenimiento
de la segunda adquisición, inscrita en el Registro de la Propiedad, a pesar
de la existencia de una previa transmisión «consumada» en el tiempo, con
destacada antelación respecto de la segunda, pero no inscrita. Este trabajo
recupera los argumentos entonces esgrimidos y prolongadamente manteni-
dos por el Tribunal Supremo, para proceder a su crítica, participando del
resultado acordado en el fallo, que atribuye la titularidad del inmueble al
titular que inscribió su adquisición, pero sin compartir el razonamiento
seguido por la Sala para desplazar de la titularidad inmobiliaria a quien,
reuniendo título y modo con anterioridad al inscribiente, no llegó a inscribir.
ABSTRACT: This work proposes a critical revision of the consolidated
doctrine of the Supreme Court regarding the protection of the so-called third
party mortgage. And it is that from the judgment of the Plenary, of the civil
chamber of the Supreme Court of March 5, 2007, the jurisprudential doctrine
regarding the concept of third party mortgage and the debated issue of the at-
tribution of property to the second acquirer when the acquisition was registered
in the Property Registry and even if there was a consummate prior transmission
but not registered. By means of this position, our High Court faces a classic
issue in the civil-mortgage sphere that, in the opinion of this author, deserves
revision, based on the aforementioned resolution, as well as in subsequent
ones that follow the criteria declared by it, already A body of jurisprudential
doctrine in this regard, the First Chamber of the Supreme Court established
doctrine on the concept of third party mortgage, responding to a legal question
that has sustained a prolonged doctrinal and jurisprudential debate around
article 1473, paragraph 2, of the Civil Code, which is the maintenance of the
second acquisition, registered in the Property Registry, despite the existence of

a previous transmission «consummated» in time, well in advance of the second,
but not registered. This work recovers the arguments then used and prolonged
maintained by the Supreme Court, to proceed with its criticism, participating
in the result agreed in the ruling, which attributes ownership of the property
to the owner who registered its acquisition, but without sharing the reasoning
followed by the room to displace from the real estate ownership who, gathering
title and mode before the registrant, did not register.

Desde hace ya más de una década la Sala Civil de nuestro Alto Tri-
bunal mantiene consolidada doctrina acerca del tercero protegido por el
artículo 34 de la Ley Hipotecaria, respecto de la que no ha procedido
a realizar ulterior consideración, a pesar de que a su través afronta una
cuestión clásica en el ámbito civil-hipotecario que a juicio de quien esto
escribe merece revisión.
