RESUMEN: La nueva tecnología de sistema de bloques o blockchain garan-
tiza las transacciones que se realizan a través de ella, llegando a plantearse si
puede ser un sustituto eficaz del Registro de la Propiedad a la hora de agilizar
y garantizar la propiedad, su transmisión y otros derechos reales, sin necesidad
de la inscripción en el Registro de la Propiedad. En este trabajo se analiza
brevemente las características de esta tecnología, para tratar de ver, después,
si sirve y en qué medida como alternativa a nuestro sistema registral español.
El examen de las especiales características de nuestro sistema registral y sus
efectos de seguridad frente a terceros e indudable contribución a la seguridad
jurídica del tráfico inmobiliario nos conducen a concluir la dificultad de dicha
sustitución.
ABSTRACT: The new technology of the block system or blockchain guarantees
the transactions that are carried out through it, even asking whether it can be
an effective substitute for the property registry when it comes to speeding up and
guaranteeing the property, its transmission and other real rights, without the need
for registration in the Property Registry. In this paper, the characteristics of this
technology are briefly analyzed, to try to see, later, if it works and to what extent
as an alternative to our Spanish registry system. The examination of the special
characteristics of our registry system, and its security effects against third parties
and undoubted contribution to the legal security of real estate traffic, lead us to
conclude the difficulty of such replacement.
