Resumen
Las organizaciones son esenciales para llevar a cabo las instituciones legales como
el derecho a la salud. Sin embargo, cuando las decisiones regulatorias están a cargo
de organizacio nes políticas, cuyas decisiones no son consistentes en el tiempo y que
dependen de un ciclo electoral, la regu lación se vuelve incierta y no técnica. Este
problema de compromiso y la naturaleza técnica del derecho requieren una
respuesta igualmente cualificada: organizacio nes políticamente más neutrales e
independientes d el Ejecutivo , racional-deliberativas y responsables ante la
ciudadanía.

1. The institutional theory and the protection of rights
Talking about effectiveness of rights implies a progressive reduction of
uncertainty and the predictability of regulator’s decisions. According to North
(1990) it is the major role of institutions, by founding a stable structure to human
interaction. Institu tions define and limit the set of choices of individuals a nd create
an institutional framework composed by the organizations developed as a
consequence.
