RESUMEN: La crisis producida por el COVID-19, trajo consigo la de-
claración de emergencia sanitaria en virtud de la cual, los distintos Estados,
impusieron un aislamiento social y preventivo —llamado «cuarentena» o
«confinamiento»— que produjo importantes efectos en las distintas rela-
ciones humanas, sea de índole económica, social, cultural y, por supuesto,
jurídicas. Así las cosas, con el presente trabajo, intentamos describir de
acuerdo al Derecho argentino el impacto en los contratos de los efectos de
la pandemia declarada por la Organización Mundial de la Salud (OMS) con
motivo del COVID-19 y su consecuencia inmediata, esto es, la ya menciona-
da «cuarentena» o «confinamiento», que aparecen como hechos extraordina-
rios e imprevisibles sin precedentes que alteraron las «bases» de los distintos
negocios jurídicos, provocando un cambio en las circunstancias existentes
al momento de su celebración; generando, de este modo, la necesidad de
revisar el contrato a través de los diferentes mecanismos previstos a tal

efecto por el ordenamiento jurídico, con el único objetivo de restablecer el
equilibrio originario de las prestaciones, preservar su continuidad y evitar,
en lo posible, su extinción.
ABSTRACT: The crisis produced by the COVID-19, brought with it the
declaration of health emergency under which the different states imposed a
social and preventive isolation —called «quarantine» or «confinement»— which
had a major impact on the various human relations: economic, social, cultural
and, of course, legal. Thus, with the present work, we try to describe in ac-
cordance with Argentine law the impact on contracts of the effects of the
pandemic declared by the World Health Organization (WHO) on the occa-
sion of COVID-19 and its immediate consequence, that is, the aforementioned
«quarantine» or «confinement», which appear as unprecedented extraordinary
and unforeseeable events that altered the «bases» of the various legal trans-
actions, causing a change in the circumstances existing at the time of their
celebration; thereby creating the need to revise the contract through the various
mechanisms provided for in the legal order, with the sole aim of restoring the
original balance of benefits, preserving their continuity and avoiding them, if
possible, their extinction.
