RESUMEN
Este trabajo parte de analizar el concepto de restricción de la competencia por el objeto
del artículo 101(1) TFUE, atendiendo especialmente a las conclusiones del Abogado General
BOBEK en el caso Budapest Bank (C228/18) y a la sentencia del TJUE sobre este asunto. Segui-
damente, estudia la conexión existente entre la noción de restricción por el objeto y los acuer-
dos de menor importancia. Con tal fin, expone tres interpretaciones sustentadas en los últimos
pronunciamientos del TJUE en relación con ambas materias. En particular, plantea la posibilidad
de aceptar que el carácter de minimis forme parte del análisis del contexto jurídico y económico
que ha de realizarse para determinar si un acuerdo constituye o no una restricción por el objeto
o por sus efectos. Finalmente, esboza las potenciales implicaciones que se derivan del análisis
anterior para nuestra normativa nacional de defensa de la competencia.

ABSTRACT
This paper starts from analyzing the concept of restriction of competition by object of ar-
ticle 101 (1) TFEU, paying particular attention to the conclusions of Advocate General Bobek
in the Budapest Bank case (C228 / 18). Then, we study the connection between the notion of
restrictions by object and minor importance agreements. With this purpose, it presents three
different interpretations supported by the latest case law of the CJEU in relation to both issues.
In particular, it suggests the possibility of accepting that the de minimis character forms part of

an agreement constitutes a restriction by object or by its effects. Finally, it outlines the potential
implications derived from the above analysis for our national competition law.
