RESU MEN:
La reforma del Reglament o de Subvenciones de
Castilla-La Mancha por el Decreto 49/ 2018 perm it e al
autor de estas líneas r eflex ionar, en primer lugar, sobre
las dificult ades de enten der adecuadam ente un
concept o com o el de “fun dación de sector público” , en
cuy a definición afirm an sus compet encias tres
ordenam ien tos jurídicos distint os y no siempre
com patibles: el de la Unión Europea, el estatal español
y los autonómicos.
En segundo lugar, se pone de m anifiest o la discut ible
adaptación que en el Decreto 49/ 2 018 se ha hecho de
la Disposición Adicional 16ª de la Ley 38/2003, de 17
de noviembre, General de Subvenciones y, por último,
se citan dos ej em plos de pr eceptos de dich o

ABSTRACT
The refor m of t he Regulation of Public Subsidies of
Castilla-La Mancha by Decree 4 9/ 2 018 allows the
author of t hese lines t o reflect, fir st of all, on the
difficulties of understanding a concept such as t he
"f oundation of t he public sect or", in wh ose definition
their compet en ces are affirm ed by three differ ent legal
systems that are not alway s compatib le: t hose of the
European Union, t he Spanish State an d th e
Aut onom ous Governm ents.
Secondly, t he controver sial adaptation that in Decree
49/2018 has been m ade of the 16t h Addit ional
Prov ision of Law 3 8/ 2003, of November 17, General of
Public Subsidies, is com m ented. And, finally, two
examples are cit ed of precept s that, despit e hav ing
been m odified by Decree 49/ 2018, continue to present ,
in the author's opinion, cont radictions with t he basic
st ate legislat ion .
