: Durante los últimos 20 años se ha producido una gran
desregulación en Alemania, pero este no es el único rasgo característico de las actuales
relaciones laborales: se ha creado un derecho al trabajo a tiempo parcial, se han
transferido las normas de protección de los consumidores a la relación laboral, se han
establecido en la práctica leyes antidiscriminación y de protección de datos, y se ha
mejorado el status legal de las agencias de colocación. Se ha establecido un salario
mínimo. Gracias a la jurisprudencia del Tribunal Constitucional se ha mejorado la
posición de los sindicatos en la empresa. Recientemente, el legislador ha facilitado que
los convenios colectivos tengan un efecto jurídicamente vinculante para todos los
trabajadores. El problema es que la desregulación siempre funciona, pero la regulación
necesita mecanismos específicos para su aplicación.
ABSTRA CT
: During the last 20 years there has been a lot of deregulation in
Germany, but this is not the only characteristic feature of present labour relations: a
right to “part-time” work was created, consumer protection rules were transferred to
the employment relationship, antidiscrimination law and data protection law were
established in practice, and the legal status of temporary agency workers was
improved. A minimum wage was introduced. Due to the case law of the

Constitutional Court, the position of the unions in the enterprise is now a better one.
Recently, the legislator facilitated collective agreements getting a legally binding effect
for non-members. The problem is that deregulation always works, but regulation
needs specific mechanisms to be implemented.
