DEL LÍMITE DE RESPONSABILIDAD DEL PORTEADOR,
CON ESPECIAL REFERENCIA AL ART. 61.3 LCTTM *

RESUMEN
Este trabajo explica el alcance del art. 61 de la Ley 15/2009, de 11 de no-
viembre, del contrato de transporte terrestre que regula las distintas modalidades
contractuales de incrementar la responsabilidad del porteador haciendo especial
hincapié en la prevista en su párrafo 3.º, en la que se prevé dicho incremento
mediante el mero aumento de su límite a raíz de la reciente Sentencia de la Sala
Primera del Tribunal Supremo de 12 de febrero de 2020, en la que se aclara su
contenido y alcance. Además, en el trabajo se formulan ciertas recomendaciones
para dar respuesta a las necesidades de los usuarios del transporte en los casos
en que vean conveniente aumentar el importe de una mayor responsabilidad de
los porteadores.

Contractual possibilities to increase the carrier’s limit of liability, with special
reference to art. 61.3 LCTTM
ABSTRACT
This article explains the scope of art. 61 of Law 15/2009, of the Contract of
Transport of Goods by Land Act that regulates the different contractual modali-
ties of increasing the liability of the carrier, with special emphasis on that provi-
ded in its 3rd paragraph, in which such increase is foreseen by the mere increase
of its limit following the recent Supreme Court Judgment of February (12 Februar
2020), which clarif‌ies its content and scope. In addition, in the work certain
recommendations are formulated to respond to the needs of transport users that
require greater responsibility of the carriers on certain occasions.

I. PLANTEAMIENTO
En este trabajo se pretende examinar el alcance del art. 61.3 de la Ley
15/2009, de 11 de noviembre, del contrato de transporte terrestre (en adelan-
te, LCTTM), en el que se prevé la posibilidad de que se acuerde el aumento del
límite de indemnización del porteador contemplado en el art. 57.1 LCTTM.
Se trata de una modalidad poco estudiada, que ha permanecido «oculta» en la
normativa reguladora del transporte, y que, recientemente, ha cobrado especial
relieve por la STS de 12 de febrero de 2020 (Sala 1.ª) (ECLI:ES:TS:2020:335),
en la que se pone de manif‌iesto el contenido y alcance de dicha disposición legal
que, quizá, a partir de ahora, pueda desempeñar un papel relevante, porque
permite ampliar la responsabilidad del porteador, cuando este así lo estime con-
veniente, no aplicando la limitación de responsabilidad prevista en el art. 57.1
LCTTM.
