RESUMEN: El 28 de noviembre de 2018 el Tribunal Supremo dictó una
sentencia de Pleno en la que confirmaba una consolidada doctrina en relación
con los intereses de demora, avalada recientemente por el Tribunal de Justicia
de la Unión Europea en su sentencia de 7 de agosto de 2018. En este trabajo
se analizará esa jurisprudencia y doctrina del Tribunal Supremo establecida en
relación a esta modalidad de intereses y, asimismo, se examinarán críticamente
las previsiones que al respecto se contienen en la Ley 5/2019, de 15 de marzo,
reguladora de los contratos de crédito inmobiliario, que no atiende a ese criterio
jurisprudencial.
ABSTRACT: On November 28th, 2018, the Supreme Court issued a Plenary
ruling confirming a consolidated doctrine in relation to interest for late payment,
recently endorsed by the Court of Justice of the European Union in its ruling of
August 7, 2018. This paper will analyze the jurisprudence and doctrine of the Su-
preme Court established in relation to this type of interest, and will also examine
critically the provisions contained in the Act 5/2019, of March 15th, regulating real
estate credit agreements, that does not comply with this jurisprudential criterion.
