Resumen / Abstract: La legalización de la gestación subrogada altruista no sólo
ofrece a las parejas infértiles la posibilidad de tener su propio hijo y evita los actos
ilegales de gestación subrogada comercial, sino que también tiene un impacto
positivo en la estructura de la población nacional al asegurar una tasa de fertilidad
total estable. En general, el actual marco jurídico sobre la gestación subrogada es
completo y se adapta a las finas costumbres y tradiciones de Vietnam. Sin embargo,
todavía se puede mejorar.

Legalization of altruistic gestational surrogacy not only gives infertile couples a chance
to have their own child and prevent illegal acts of commercial surrogacy, but it also
makes a positive impact to the national population structure by securing a stable total
fertility rate. In general, the current legal framework on surrogacy is comprehensive
and adaptable into to Vietnam’s fine customs and traditions. However, there is still
room for improvement.

1. The situation of Vietnam prior to the legalization of altruistic
gestational surrogacy
1.1. The social thread of infertility in Vietnam and surrogacy as a solution
In Vietnamese culture, it is very crucial for a family to have children in
order to continue the family name, especially when the father and/or the
mother themselves are the only child. In the past few years, there has been
an increasing number of couples not having the ability to reproduce and
therefore cannot have children of their own. According to data from the
Vietnam Center for Fertility Support - National Hospital of Obstetrics and
Gynecology, in year 2008, this center only received 2-3 cases a day with
infertility problems. However, by 2015, this number has signifi cantly increased
by 20 times.1
It is also worth noting that the number of the young who suffer from
infertility in Vietnam is rising. According to a study by Hanoi Medical Univer-
sity in collaboration with the National Hospital of Obstetrics and Gynecology,
in 08 out of 63 provinces, more than 14,300 couples of reproductive age
shows that the rate of infertility in Vietnam is increasing up to 7.7%, in
which the primary infertility and the secondary infertility rates are 3.9%
and 3.8% consecutively. That means Vietnam is having about 700,000 to
1 million infertile couples. In particular, 50% of them are couples under the
