STRATEGIES AND INFERENCES IN THE COMPREHENSION OF JURIDICAL TEXTS: THE CASE OF THE SINGLE EUROPEAN ACT

The study of lingüístic com-munication can be approached from two different angles: that of the code or message, and that of in-ference. According to the latter, communication would be a morè complex phenomenon in which the presence of a context would have to be taken into account. This context may be defined as a set of pre-mises used to intèrpret a lingüístic statement. This set of premises is identífied with some common know-ledge according to which -in order for the communication to be successful- the emitter and the receiver have to share some informa-tion. The knowledge they share is the following: lingüístic, com-municative, h'terate, and conversa-tional presumptions. Inference can therefore be defined as the cognitive process by which the receiver ac-quires new information from given information (the text), taking ínto account other information (the context and shared knowledge).

In the case of the Single European Act (SEA), a specific example of a legal text, the emitter presupposes that in order for the receiver to unders-tand it, he/she possesses four kinds of knowledge: cultural, juridical, lingüístic and practical. The strategies proposed by the author to intèrpret this text are also four: typological (what kind of document it is), pragmàtic (what the function of the text is and how it can be reached), semàntic (what the content of the text is), and syntactic (how the content of the text is expressed). These four strategies are interdependent.

A systematization of the process of textual comprehension Iike the one presented can be useful to help solve problems of juridical inter-pretation, especially considering the interest communication theory has when applied to texts of a jurídica] nature with very clearly defined límits.

L'estudi de la comunicació lingüística es pot enfocar a partir de dos models: el del codi o del missatge, i el de la inferència. Segons aquest darrer model, la comunicació seria un fenomen més complex en el qual caldria tenir en compte la presència del context. El context es podria definir com el conjunt de premisses utilitzades per interpretar un proferí-ment lingüístic. Aquest conjunt de premisses s'identifica amb un coneixement mutu segons el qual -i perquè la comunicació tingui èxit- l'emissor i el receptor han de compartir una sèrie de coneixements. Els

coneixements compartits són els següents: presumpcions lingüística, comunicativa, de literalitat i con-versacionals. La inferència, per tant, es pot definir com el procés cog-nitiu pel qual el receptor adquireix noves informacions a partir d'informacions donades (el text), tenint en compte altres informacions (el context o coneixement compartit).

Passant a l'exemple concret d'un text legal com és l'Acta Única Europea (AUE), per tal de comprendre'l l'emissor pressuposa en el receptor quatre tipus de coneixement: cultural, jurídic, lingüístic i pràctic. Les estratègies proposades per l'autora per interpretar aquest text també són quatre: tipològica (¿de quin tipus de text es tracta?), pragmàtica (equina és la funció del text i com s'hi pot arribar?), semàntica (¿quin és el contingut del text?) i sintàctica (¿com s'expressa el contingut del text?). Aquestes quatre estratègies són interdependents.

Una sistematització del procés de la comprensió textual com la que s'exposa pot servir per facilitar la resolució de problemes d'interpretació jurídica, sobretot tenint en compte l'interès que presenta l'aplicació de la teoria de la comunicació a textos com els jurídics, amb límits molt clars í definits.

THE USE OF THE CONJUNCTION "I" BETWEEN THE LAST NAMES IN SPANISH REGISTERS AND SENTENCES

The present article was written in an effort to darify the details of the case of Mr. Miquel-Jordi Strubell, who appealed to all existing judicial bodies to denounce the violation of the principle of equality of which he was made object when he was denied the right to use his own of-ficial language -Catalan- to in-scribe his son in the civil register, a negative that extended to the use of the Catalan copulative conjunction i between the paternal and maternal last names. In view of the confusion the press created around the case, the author of the article wishes to clarify the conclusions that can be extracted from it.

The legal arguments used to turn down the different appeals submit-ted by Mr. Strubell go back to the law and regulation of the Civil Register, which were passed in 1958, and which establish that Spanish be the only language to be used at the Register. The General Directorate of Registers and Notaries argued that according to the Spanish Constitution, Spanish citizens have the duty to know Spanish and, therefore, its use in the Register cannot be regarded as discriminatory.

Although the Barcelona Territorial Audience recognized the right to use the conjunction i, it did not accept that the Register could inscribe Mr. StrubelFs son in Catalan. His subsequent appeals to the Supreme Court and the Con-stitutional Court did not change the previous sentence.

The author qüestions the pre-sumption of the courts that the on-ly language of internal use in the registers be Spanish and he accuses them o£ following the legal spirit of 1958 rather than applying what the Constitution or the Statutes of Autonotny have established on language matters.

LA "I" ENTRE APELLIDOS EN LOS REGISTROS ESPANOLES Y EN LAS SENTENCIAS

El presente articulo parte de una voluntad de aclaración de los detalles sobre el caso del Sr. Miquel-Jordi Strubell, quien recurrió a todas las instancias judiciales existentes para denunciar la vulneración del principio de igualdad de que había sido objeto al no haber podido usar la lengua oficial pròpia -en este caso, el catalan- para inscribir el naci-miento de su hijo en el Registro Civil, negativa que se extendió a la uti-lización de la conjunción copulativa i entre los dos apellidos. En vista de la confusion creada por la pren-sa en torno a este caso, el autor del articulo desea aclarar las conclusio-nes que se pueden desprender del mismo.

Los argumentos legales utilizados para denegar los recursos presenta-dos por el Sr. Strubell se remontan a la Ley y al Reglamento del Registro Civil, que datan de 1958, y que establecen que el castellano es el úni-co idioma a utilizar en el Registro. La Dirección General de Registros y Notariado arguyó que, según la Constitución Espanola, todo espa-nol tiene el deber de conocer el castellano y que, por consiguiente, uti-

lizarlo en el Registro no constituye discriminarien alguna.

Aunque la Audiència Territorial de Barcelona reconoció el dere-cho a usar la copulativa i, no ad-mitió que el Registro tuviera que inscribir al hijo del Sr. Strubell en catalan. Sus posteriores apelaciones al Tribunal Supremo y al Tribunal Constitucional no alteraron dicha sentencia.

El autor discute la presunción de los tribunales de que la única lengua de uso interno en los regis-tros sea el castellano y los acusa de guiarse por el espíritu legal de 1958, en lugar de aplicar lo establecido en matèria lingüística en la Consti-tución o en los Estatutos de Autonomia.

THE SINGLE EUROPEAN MARKET, MINORTTY LANGUAGES AND THE FLEMISH PEOPOSAL OF THE EUROPE OF CULTURES

The foundational treaties of the European Community, along with the Treaty of Maastricht, encourage the existence of economies of scale on a Community level, and thus af-fect languages and cultures with a lesser demographic and/or econòmic potential. Cultural and lingüístic production cannot be seen as unrelated to such economies, and is clearly affected by the suppression of barriers, as is shown by such ex-amples as the labeling of food pro-ducts, and publishing, educational or àudio-visual policies.

The Treaty of Maastricht slight-ly modifies a trend whereby, in earlier European treaties, there was an absence of references to cultural matters, although it is not clear, either, that the new treaty favors quantitatively minor cultures.

In víew of the possibility that the survival of these minority cultures within the ec be under threat, and in view of the discrepàncies between cultural and econòmic policies, the government of the Flemish Com-munity has submitted a cultural and lingüístic proposal, the «Europe of Cultures», whereby the European Union is to be built taking into con-sideration cultural regions within the ec rather than States. In order to do that, it is necessary to adjust market economy to cultural needs through the protection of weaker cultures. With this goal in mind, the project defines the notions of «cultural region» -which is simultaneously based on cultural, econòmic, política], and ad-ministrative factors-, and «cultural adjustment of the market», which would entail the right to enforce stricter laws in order to protect minority cultures from majority cultures.

In order to reestablish a balance within the ec market in favor of demographically minor cultures, a European Community of Cultures should be created, or else, certain Community freedoms should be allowed to have exceptions.

EL MERCADO ÚNICO, LAS LENGUAS NO MAYORITARIAS Y LA PROPUESTA FLAMENCA DE LA EUROPA DE LAS CULTURAS

Los tratados constitutivos de la CE, junto con el Tratado de Maastricht, favorecen la existència de economías de escala a nivel comu-nitario, afectando así a las lenguas y culturas con un potencial demo-grafico y/o económico menor. de escala, quedando ckramente afectada por la supresión de barreras, como lo demuestran los ejemplos del etiquetado de productos alimenti-cios, las políticas editoriales, educa-tivas o audiovisuales.

El Tratado de Maastricht modifica ligeramente la tònica según la cual en los tratados europeos había una ausencia de referencias a los as-pectos culturales, aunque tampoco està claro que las culturas cuantita-tivamente menores se vean favore-cidas por ello.

Ante la posibilidad de que la subsistència de estàs culturas no mayo-ritarias de la Comunidad se vea ame-nazada, y ante las discrepancias entre política cultural y política econòmica, el gobierno de la Comunidad Flamenca ha presentado la pro-puesta cultural y lingüística de la «Europa de las Culturas», según la cual la Unión Europea debe cons-truirse sobre la base de las regiones culturales de la Comunidad, y no tanto a partir de los estados. Para ello, es preciso ajustar la economia de mercado a las necesidades culturales mediante una protección de las culturas mas débiles. De este modo, el proyecto define los conceptos de «región cultural» -que reposa simul-taneamente sobre los pilares cultural, económico y político-administrativo- y «ajuste cultural del mercado», que induiria el dere-cho a aplicar leyes mas estrictas para protegerse de las culturas mayori-tarias.

Para reequilibrar el mercado co-munitario en beneficio de las cultu-ras demograficamente menores de-bería crearse una Comunidad Europea de las Culturas, o bien abrir la posibilidad de que determinadas Iibertades comunitarias pudieran te-ner excepciones.

A NEW LINGÜÍSTIC MODEL FOR EUROPE

Although in so me ways the linguistic model of the European Community tries to prevent the pro-gressive impoverishment of European Ianguage plurality, in practice this model is not only discriminatory as regards languages within the ec that are not state languages, but also contradicts some Community principies, such as subsidiarity, or the notion o£ serving its citizens instead of usïng them. At the same time, the crisis of the definition of official and work languages is made morè evident with the prospect of an ec enlargement.

In order to stimulate pluri-lingualism, the author proposes that the ec promote the study of a minimum of two Community languages, in addition to one's own of ficial Ianguage. Moreover, in order to guarantee the survival of Europe's cultural and linguistic heritage, the EC should push forward measures of «positive discrimination» to halt the tendency by business and political interests in general to reduce the number of languages used.

It is becoming necessary to for-mulate a new linguistic model for Europe based on strict respect for languages in their geographical context, giving them priority over other languages, even if the latter are state languages. Instead of the distinction between «official» and «other» languages, EC criteria should be aimed at distinguishing between «work languages» - which should not exceed four or five; it is important to bear in mind the bilingual model of the European Council- and «all other languages». The latter would all become official languages.

The goal would be for the EC to give preference to the defense of its cultural and linguistic heritage in the face of any econòmic considerations. In this sense, it would be important to strengthen the functions and powers of the European Bureau of Leser Used Languages.

UN NUEVO MODELO LINGÜÍSTICO PARA EUROPA

Aunque de algun modo el modelo lingüístico de la Comunidad Europea trata de evitar el progresivo empobrecimiento del mosaico lingüístico europeo, en la pràctica dkho modelo no solo es discrimi-natorio respecto a las lenguas no estatales de la ce, sinó que también contradice algunos principios comu-nitarios como el de subsidiariedad o la idea de servir a los ciudadanos y no servirse de estos. Paralelamen-te, la crisis del concep to de lengua oficial y de trabajo se hace mas evi-dente ante una eventual ampliación de la ce.

Para estimular el plurilingüismo, el autor propone que la ce debe promover el estudio de un mínimo de dos lenguas comunitarias, ademàs de la lengua oficial pròpia. Asimis-mo, para garantizar la supervivència del patrimonio lingüístico y cul-

tural europeo, la ce debe impulsar medídas de «discriminación positiva» que frenen la tendència del mer-cado y el poder en general a reducir el número de lenguas utilizadas.

Se hace necesario formular un nuevo modelo lingüístico para Europa basado en el estricto respeto de las lenguas en su àmbito geogràfi-co, otorgàndoles prioridad ante las demàs lenguas aunque éstas sean es-tatales. En lugar de la distinción entre «lenguas oficiales» y «otras lenguas», el criterio de la CE debe orientarse a distinguir entre «lenguas de trabajo» -que a lo sumo debe-rían ser cuatro o cinco; es importan-te tener en cuenta el modelo bilingüe del Consejo de Europa- y «todas las demàs lenguas». Estàs úl-timas serían todas reconocidas ofi-cialmente.

El objetivo seria que la CE diera preferència a la defensa de su patri-monio cultural y lingüístico frente a las consideraciones economicistas. En este sentido, seria importante re-forzar las funciones y competencias de la Oficina Europea para las Lenguas Menos Difundidas.

CENTRIPETAL AND CENTRIFUGAL FORCES AFFECTING LANGUAGE POLICY IN SCANDINAVIA

The present article examines the phenomenon of Scandinavian cooperation since World War II and its effects on language policies im-plemented in the countries involv-ed. According to the authors, the essence of such cooperation lies in certain centripetal forces resulting from lingüístic and cultural simila-rities between Nòrdic countries. Most Ianguages spoken in the region are cognates and their degree of in-tercomprehensibility is considerably high. Exceptions to this situation do not pose serious obstacles to cooperation thanks to bilingual prac-tices in most of these countries. The historical background, the political situation, as well as the current language patterns of the population are analyzed. Another aspect taken into account are the means used in some cases to resist outside influence or to improve situations of cultural or political ínferiority of an autochthonous language.

Even in the cases where language similarities are not so obvious, political and cultural connections compensate for such centrifugal factors and contribute to a general sense of cooperation and rela-tedness. Among these connections, an important common trait worth pointing out is the Scandinavian welfare system, whích is based on a comprehensive social security system and on high standards in education.

Despite the presence of both centrifugal and centripetal forces affecting Scandinavian cooperation, there exísts general consensus to support centrifugal forces in or-der to strengthen internal Scandinavian ties.

LAS FUERZAS CENTRÍPETAS Y CENTRÍFUGAS QUE AFECTAN LA POLÍTICA LINGÜÍSTICA EN ESCANDINAVIA

El presente articulo examina el fe-nómeno de la cooperación escandinava desde la Segunda Guerra Mundial y sus efectos sobre las distintas políticas lingüísticas aplicadas en los países nórdicos. Según los autores, la esencia de dicha cooperación se basa en ciertas fuerzas centrípetas que resultan de las similitudes lin-güísticas y culturales entre estos países. La mayoría de las lenguas que se hablan en la región tienen oríge-nes comunes y su grado de intercom-prensibilidad es por ello notablemen-te alto. Las excepciones a esta situación no suponen un gra ve obs-taculo de cara a la cooperación gra-cias al bilingüisme existente en la mayoría de dichos países. Se anali-zan tanto los precedentes históricos, como la situación política y las pau-tas lingüísticas de la población actual. Otro aspecto que se contempla son los medios que, en algunos casos, se utilizan para resistir la influencia externa o para mejorar si-tuaciones de inferioridad cultural o política de un idioma autóctono.

Incluso en los casos en los que las similitudes lingüísticas no son tan obvias, las conexiones políticas y cul-

turales equilibran estos factores cen-trífugos y contribuyen a ese senti-do de cooperación y de parentesco. Entre estàs conexiones cabé destacar un importante rasgo común, el estado del bienestar escandinavo, ba-sado en un sistema de seguridad social muy completo y en unos nive-les de exigència muy altos en matèria educativa.

A pesar de la presencia de fuerzas tanto centrífugas como centrípetas que afectan la cooperación escandinava, existe un consenso general en el sentido de dar apoyo a las fuerzas centrífugas para así reforzar los la-zos internos escandinavos.

THE USE OF CATALAN LANGUAGE IN 19TH-CENTURY IN CUBA

Although 19th-century Catalan migration to Cuba was a relatively reduced and late phenomenon com-pared to migration coming £rom other parts of Spain, it exerted a great influence on Cuba's cultural, political and econòmic life.

Catalans who migrated to Cuba tended to settle in urban areas, par-ticularly in Havana, Santiago de Cuba, and Matanzas. They soon stood out in trade, industry, and culture. During the last third of the 19th century, there were around 8,000 Catalans in Cuba, and most of them were members of one or morè of the four associations devoted to maintaining and spreadíng Catalan language and culture: the Sociedad de Beneficència de Naturales de Cataluna, the Sociedad Humorística Provincial de Cataluna -usually referred to by the name of its choir, «da Colla de Sant Muç»-, the Centre Català -whkh in 1887 absorb-ed the «Colla de Sant Muç»-, and the Comissió de l'Ermita de Montserrat. The Comissió organized mass gatherings to honor the Virgin of Montserrat, Catalonia's patron saint, which became highly popular in Havana.

Their cultural awareness and sound financial position made it possible for Catalans not only to keep their language at home, but also to use it on many other occasions: at the theatre, in literary competi-tions, lectures, choir concerts, etc. Sorne shopkeepers used Catalan with their customers, and some manufacturers even labelled their products in Spanish and Catalan. Moreover, the Catalan population in Cuba was the first to publish magazines in Catalan in America, although they were irregular and short-lived. There were about six Catalan magazines, but only issues from Lo fill de'I pardal and L'Almogavarhave survived. The im-portance of Catalan presence in Cuba confirms the need to study it further.

L'ÚS DE LA LLENGUA CATALANA A CUBA DURANT EL SEGLE XIX

Malgrat que la migració catalana a Cuba va ser força minoritària i tardana en relació amb la d'altres parts d'Espanya, la seva presència en la vida econòmica, política i cultural de l'illa durant el segle XIX va exercir una considerable influència.

Els catalans que van emigrar a Cuba es van concentrar als nuclis urbans, sobretot a les ciutats de l'Havana, Santiago de Cuba i Matanzas. La colònia catalana es va destacar ràpidament en àmbits com el co-

merç, la indústria i la cultura. Al darrer terç del segle xix ja hi havia uns 8.000 catalans, agrupats majoritàriament en quatre associacions que mantindrien i difondrien la cultura i la llengua catalanes a Cuba: la Societat de Beneficència de Naturals de Catalunya, la Societat Humorística Provincial de Catalunya -coneguda popularment amb el nom de la seva coral, la Colla de Sant Muç-, el Centre Català -que el 1887 va absorbir la Colla de Sant Muç- i la Comissió de l'Ermita de Montserrat. Aquesta darrera organitzava aplecs multitudinaris en honor de la More-neta que van gaudir d'una àmplia popularitat a l'Havana.

L'afany cultural dels catalans i la seva sòlida posició econòmica van fer possible que la llengua catalana no solament es mantingués en l'àmbit familiar, sinó que fos objecte de representacions teatrals, certàmens literaris, conferències, concerts de corals, etc. Fins i tot alguns comerciants atenien al públic en català i etiquetaven els seus productes tant en castellà com en català. A més, la colònia catalana de Cuba va ser la primera d'Amèrica que va publicar revistes en català, malgrat la trajectòria irregular i efímera d'aquestes publicacions. Entre aquestes revistes - que devien ser unes sis-, avui s'han conservat exemplars de Lo fill de'l pardal i L'Almogavar. La importància de la presència catalana a Cuba confirma la necessitat de continuar aprofundint en el seu estudi.
