1. INTRODUCTION
For the first time in Brazilian constitutional history, at Brazilian
Constitution 1988, ethnical identity has become new foundation for
property rights. Under critical and post-colonial methodology, this
fundamental right is supposed to coexist to traditional and economic
property foundation, a heritage from colonial period.
This innovation had the main objective to promote social inclusion
to a specifi c social group, the quilombolas communities, one of the main
actors on land confl icts in Brazil. However, after Brazilian Constitution
1988, land confl icts and violence against those communities increased.
The aim of this paper is to present briefl y confl icts coming from
incompatibilities between those two di erent property rights foundations,
one colonial, individual and economic and the other one post-colonial,
collective and ethnical.
Quilombolas are descendants of slaves and ex-slaves. This term
“quilombolas” were created and positivated by Brazilian Constitution
1988 to defi ne “quilombolas communities” as remaining communities of
slave descendants. During slavery in Brazil, in pre-republican period2,
