ABSTRACT
Pursuant to art. 87(1) European Patent Convention (EPC), a right of priority can be claimed
by the applicant and/or by his successors in title. Flexibility is granted by allowing succession in
title between the applicants of the priority application and the subsequent application. The need
for determining succession in title also arises in corporate transactions and in connection with
subsequent assignment of the initial application, and with it the priority right under the European
as illustrated in the CRISPR/Cas9 case. It may be necessary to determine the identity of the
applicants, for example in cases in which the original applicant authorizes a representative to act
on his behalf or when there is disagreement between the holders of a priority application as to
