Dever de desaplicação administrativa de normas inconstitucionais
O Conselho de Disciplina da Federação Portuguesa de Futebol instaurou um processo disciplinar a um treina-
dor desportivo, no qual este vinha acusado de uma infração de acordo com a qual, no âmbito da celebração
do contrato de trabalho de treinador desportivo, tinha prestado falsas declarações e atuado simulada ou
fraudulentamente ao estabelecido na legislação desportiva e contratação coletiva. No âmbito deste processo
disciplinar, suscitou-se a dúvida de se saber se a norma regulamentar sancionatória, bem como o regulamento
que a prevê, consubstanciam um conjunto de inconstitucionalidades materiais e orgânicas e ilegalidades por
violação de direitos fundamentais, com natureza de direitos, liberdades e garantias. Neste artigo abordaremos
o dever de desaplicação de normas inconstitucionais por órgãos administrativos.

Duty of administrative disapplication of unconstitutional norms
The Disciplinary Board of the Portuguese Football Federation initiated disciplinary proceeding against a foot-
ball coach, in which he was accused of the infraction according to which, when concluding an employment
contract as a sports coach, having made false statements and acted in simulation or in fraudulent manner
to what is established in the sports legislation and collective bargaining. In the context of the disciplinary
proceeding, the question was raised as to whether the regulatory norm that imposes sanctions, as well as the
regulation that provides for it, constitute a set of material and organic unconstitutionalities and illegalities due
to the violation of fundamental rights in the nature of rights, freedoms and guarantees. In this article we will
address the duty of disapplication of unconstitutional rules by administrative bodies.
