1. INTRODUCTION
Article 45 of the 1978 Spanish Constitution states:
«All people have the right to enjoy the environment for personal edi-
cation and also the duty of conservation. e public authorities shall
oversee the reasonable use of all natural resources, with an aim to pro-
tect and improve the quality of life and to reserve and reclaim it with
the help of the people.

is chapter examines environmental crimes in Spain from the point
of view of crime prevention. As the Spanish Constitution highlights, the en-
vironment is important both for humans and for its own sake, enough to
warrant sanctions against those who harm it. Yet, the environment and those
living within it continue to be subject to widespread damage, destruction and
diminishment in a variety of ways. Preventing environmental harms therefore
remains of vital importance as does responding adequately when such harms
do occur.
e chapter begins by outlining the key concerns of green criminology,
an eco-justice framework, and the nature of environmental crime and harm.
e next section considers crime prevention as it is applied to environmental
crime, using illegal shing to illustrate specic approaches and techniques.
e nal section provides discussion of interesting and innovative ways in
which crime prevention is carried out in regards eco-justice and environmen-
tal crime issues.
2. GREEN CRIMINOLOGY, ECO-JUSTICE
AND ENVIRONMENTAL CRIME
Green Criminology refers to criminological research and scholarship
comprised of a number of distinct theoretical approaches that collectively deal
with environmental and animal rights issues. It includes work that spans the
globe (Arroyo-Quiroz & Wyatt, 2018; Goyes, 2019; Goyes et al. 2017; Sol-
lund, Stefes&Germani, 2016; South &Brisman, 2013; White &Heckenberg
2014).As a whole, green criminology focuses on the nature and dynamics
of environmental crimes and harms (that may incorporate wider denitions
of crime than that provided in strictly legal denitions), environmental laws
(including enforcement, prosecution and sentencing practices), environmental
regulation (systems of administrative, civil and criminal law that are designed
to manage, protect and preserve specied environments and species, and to
