CONSCIENTIOUS OBJECTION INFORMED BY
SOUND SCIENCE

1. Background
Some regulations and laws about new rights are
coercing scientists and health care providers to refer for
certain legalized treatments. These professionals are dis-
criminated as insolidarian outliers, labeled as conscien-
tious objectors to be tolerated and ultimately excluded
from the profession. The new regulations have also an
important impact on patients, caregivers and society.
2. Purpose
To describe the situations where it is possible to ob-
ject not only on conscientious grounds but also on scien-
tifically reasonable doubts.
3. Method
An online search has been performed to identify:
firstly, updated existing scientific researches questioning
the effectiveness and dangerous side effects of ethically
controversial practices; secondly, domestic laws and case-
law that legalize or allow these practices; thirdly, upda-
ted position statements from global health professional
organizations about these topics. Finally, international
law and deontological statements about the conscien-
tious objection to these practices have been identified.
4. Result
Jurisdictions where ethically controversial practices
are legalized or allowed have encountered the increa-
sing infringement of several basic health care principles,
such as benefit and no harm, informed consent and au-
tonomy.
5. Conclusion
The rise of conscientious objection to some actions
required by some national norms regulating new rights
makes necessary the development of legal provisions
protecting the freedom of conscience for doctors, nurs-
es, midwives, pharmacists and related health care pro-
viders. A more environmentally concerned approach to
human life could facilitate the task.
