Comment to the Judgement 349/2020, of March 10, 2020; from the Conten-
tious-Administrative Chamber of the Spanish Supreme Court, that estimates
the Appeal interposed by the National Commission of Markets and Competition
against articles 1 and 2 from the Royal Decree 1076/2017, of December 29, by
which complementary rules to the regulation of the Ordination of Land Transport
Law (approved by Royal Decree 1211/1990) in relation with the exploitation of
vehicle rental with driver authorizations, are established

Resumen: Como consecuencia de diferentes modificaciones introducidas en la legislación españo-
la sobre transporte terrestre, y en particular del arrendamiento de vehículos con conductor (VTC),
se produjo una concesión masiva de licencias que afectó al sector, en particular al taxi. Muchas de
esas licencias se adquirieron con ánimo especulativo, y exclusivamente para que una vez se limita-
ra su concesión, se revalorizaran y fueran vendidas, sin tener por objeto real la prestación del ser-
vicio para el que fueron solicitadas. Para evitar las distorsiones existentes, se limitó a 1/30 la pro-
porción de licencias de VTC/taxi y se limitó el ámbito geográfico de actuación, debiendo plasmarse
los servicios en “hojas de ruta” a disposición de la Administración. El Real Decreto 1076/2017, de
29 de diciembre, introdujo posteriormente la necesidad de haber desarrollado efectivamente la
actividad durante dos años para poder transmitir la licencia VTC (artículo 1) y modificó la obliga-
ción de información al envío de esta a un Registro electrónico, al prestarse el servicio (artículo 2).
La Comisión Nacional de los Mercados y la Competencia (CNMC) recurrió dichas limitaciones, por
considerarlas contrarias a la libre competencia y a la unidad de mercado, resultando una Sentencia
estimatoria que anuló los artículos 1 y 2 del Real Decreto. Consta, no obstante, un interesante voto
particular contrario a la Sentencia de tres de los Magistrados actuantes.
Abstract: After various modifications introduced in the spanish legislation on land transport, and
in particular the leasing of vehicles with driver (VTC), there was a massive granting of licenses

affecting to the sector, particularly taxi. Many of these licenses were acquired speculatively, and
exclusively to be revalued and sold, without having as their real purpose the provision of the ser-
vice for which they were requested. To avoid existing distortions, the ratio of VTC / taxi licenses
was limited to 1/30, the geographical scope of action was limited too, and the services should be
reflected in reports available for the Administration. By Real Decreto 1076/2017, of December
29, was introduced the need to have effectively carried out the activity for two years to be able
to transmit the VTC license (article 1) and modified the obligation of information for sending it to
an electronic Registry (article 2). The Spanish National Merchants and Competition Commission
(CNMC) appealed these limitations, considering them contrary to free competition and market
unity, resulting in an affirmative judgment that annulled articles 1 and 2. The Judgement, howe-
ver, includes an interesting individual opinion made for three of the acting Magistrates.
