What is Collaborative Divorce?
Collaborative Divorce is a dispute resolution model in which both parties to
the dispute retain separate, specially-trained lawyers, coaches and financial pro-
fessionals, whose only job is to help them settle all issues in their dissolution.
IF the clients do not resolve all issues in this way, the lawyers and professionals
withdraw from further representation; can never represent either client against
the other again. All participants (lawyers, clients, coaches and financial experts)
agree to work together respectfully, honestly, and in good faith to try to find “I
can live with this” solutions to the legitimate needs of both parties. The parties
agree at the beginning that neither will go to court, or even threaten to do so, and
if that should occur, the Collaborative Divorce process terminates and the lawyers
and other professionals are disqualified from any further involvement in the case.
Because of these agreements at the outset, and the requirement that all professio-
nals will withdraw if litigation does proceed, the parties have a huge investment in
making the Collaborative Divorce process work.
Que es un Divorcio Colaborativo?
Un Divorcio colaborativo es un modelo de resolución de controversia en la cual
