RESUMEN
La Decisión 486 de la Comunidad Andina, que establece el régimen común andino de
propiedad industrial, cumple este 2020 veinte años de vigencia, lo que no solo vuelve pertinente
sino necesario analizar cómo este marco previó proteger un elemento tan importante como el
diseño industrial, en particular, cómo este se encuentra def‌inido y cuál es el alcance de los re-
quisitos sustantivos exigidos para su protección, ello bajo una interpretación coherente con los
f‌ines que busca alcanzar este sistema.

ABSTRACT
Decision 486 of the Andean Community, which establishes the common legal regime for the
protection of industrial property, celebrates its 20th anniversary this year, which makes not only
pertinent but necessary to analyse how this regulation shaped the protection of such an essential
element as industrial design, in particular, the def‌inition of the eligible matter for protection and
the scope of the respective substantive requirements, under an interpretation consistent with the
desired goals of this system.
