ADQUISICIÓN DE LA PROPIEDAD DEL PATRIMONIO DEL ENEMIGO EN
ÉPOCA ROMANA

RESUMEN
La Historia de Roma se ha visto profundamente afectada por la expansión
territorial llevada a cabo, principal aunque no exclusivamente, a través de la guerra. Uno
de los grandes incentivos del interés romano por ampliar su área geográfica ha sido la
adquisición de la propiedad no sólo del terreno, sino también de los bienes de la
población dominada. Desde una perspectiva jurídica, esta apropiación se realizó con dos
instituciones: la occupatio de las res hostiles y el botín de guerra. La ocupación de las
cosas del enemigo suponía la adquisición individual de la propiedad de los bienes por
parte de los soldados romanos, y era considerada la forma más antigua y legítima de
adquirir la propiedad. Por el contrario, el botín de guerra daba lugar a una propiedad
colectiva por parte del populus Romanus.

ABSTRACT
The History of Rome has been deeply affected by the territorial expansion
carried out, mainly though not exclusively, through war. One of the great incentives of
the Roman interest to expand its geographic area has been the acquisition of the
ownership not only of the land, but also of the assets of the dominated population. From
a legal perspective, this appropriation was carried out with two institutions: the
occupatio of the res hostiles and the spoils of war. The occupation of the things of the
enemy supposed the individual acquisition of the property of the goods by the Roman
soldiers, and it was considered the oldest and more legitimate way to acquire the
property. On the contrary, the spoils of war gave rise to a collective property by the
populus Romanus.
