THE WORKING ACTIVITY TEST AND THE DIALECTICS OF THE SIGNS OF SUBORDINA-
TION AND AUTONOMY. Wilfredo Sanguineti Raymond
Abstract: The revaluation of the working activity test as a useful tool to solve
the problems of qualification and assignment of legal guardianship related to
the emergence of new ways of working, it makes one of the most unexpected
findings of the Labour Law during the health crisis. This revaluation has been
the result of a careful process of legal and doctrine building, which has led to the
statement of the working nature of the work made through digital platforms by
the highest legal authorities of a large number of European countries, included
Spain. This article deeps in the analysis of this process, revealing how it has been
useful to provide very important elements of judgement to solve the main meth-
odological problem which, from the beginning, has presented the working activ-
ity test , as it is the poor specification of the approach which must prevail the
selection of the signs to take into account to decide if the link must or mustn´t
be considered as a paid work in the cases in which the results are contradictory,
although reasonable at the beginning.
