Abstract: This article explains the general outline of the constitutional protection
of the old age in Spain on the base of the recognition of adequate and up-to-date
retirement pensions and a comprehensive protection of this situation through the
social services, health, housing, culture and leisure which is a scheme accepted
and recognized by the European texts in the public area of the social policies. In
the first decade of the 21st century an affirmative version of the so-called active
ageing was introduced in which from a principle of self-fulfillment of the person
the need of creating the opportunity of working is planned. However, the inrush
of the crisis places this problem in the lengthening of the retirement age and the
sustainability of pensions without solving it in the framework of employment
policies. The text finally analyzes critically the measure of the active retirement
as a typical term of the so-called active ageing, underlines its weak points, and we
conclude stating that only in a new legal framework of the working relationship,
which corrects the precariousness in the contracts and the facilitation and cheap-
ening of dismissal, will be considered in a right way the probablity elder people
can have the possibility of staying voluntarily in the performance of their work
or professional activity and growing old actively as it is proclaimed rhetorically.

Abstract: In a very problematic legal context of the European Union Social Law,
we analyse the most recent conflicts relating to the safeguarding of employees’
rights in the event of transfers of undertakings, or of businesses (or of parts of
undertakings or businesses), what it is become complicated legally and techni-
cally even more when we place ourselves in the succession of staff in the transfer
of undertakings under the collective bargaining agreement mandate.
